SharkCasino Affiliate Program Terms & Conditions (Anjouan Licensed)

SharkCasino operates under a valid Anjouan (Union of the Comoros) Gaming License. These Terms & Conditions (“Agreement”) govern participation in the SharkCasino Affiliate Program (“Program”) via Obsidian Affiliates using RavenTrack.

By applying to or participating in the Program, you (“Affiliate”) agree to be bound by this Agreement.

1. Definitions

  • SharkCasino / We / Us / Our – The licensed operator of the SharkCasino brand.

  • Affiliate – Any individual or legal entity approved to promote SharkCasino.

  • Player – A user who registers and plays at SharkCasino via an Affiliate tracking link.

  • Tracking Platform – RavenTrack, used via Obsidian Affiliates.

  • Net Gaming Revenue (NGR) – Gross bets minus winnings, bonuses, chargebacks, fraud, payment processing fees, gaming taxes, and administrative costs.

  • Commission – Affiliate remuneration based on agreed Revenue Share, CPA, or Hybrid model.

2. Licensing & Regulatory Status

2.1 SharkCasino is licensed and regulated under the Anjouan Gaming Authority, Union of the Comoros.
2.2 Affiliates acknowledge that the Anjouan license does not permit marketing in all jurisdictions.
2.3 Affiliates are solely responsible for ensuring their promotional activities comply with all applicable local laws and regulations in the jurisdictions they target.

3. Enrollment & Approval

3.1 All Affiliate applications are subject to review and approval at our sole discretion.
3.2 We may reject or terminate any application or account without obligation to provide justification.
3.3 Submission of false, misleading, or incomplete information may result in immediate termination.

4. Affiliate Obligations

Affiliates agree to:

  • Promote SharkCasino in a lawful, ethical, and responsible manner

  • Clearly present SharkCasino as an Anjouan-licensed operator

  • Avoid implying licensing or regulation by MGA, UKGC, or any other authority

  • Use only approved tracking links and marketing assets

  • Ensure all content is accurate, non-misleading, and current

  • Comply with responsible gambling standards

5. Restricted & Prohibited Jurisdictions

5.1 Affiliates must not target or accept traffic from jurisdictions where online gambling is prohibited or where SharkCasino does not accept players, including but not limited to:

  • United States (and its territories)

  • United Kingdom

  • France

  • Netherlands

  • Spain

  • Italy

  • Any other restricted jurisdiction listed in the Affiliate dashboard

5.2 Affiliates are responsible for geo-targeting and compliance.
5.3 Traffic from restricted jurisdictions may result in commission forfeiture.

6. Prohibited Marketing Practices

Affiliates are strictly prohibited from:

  • Targeting minors or vulnerable persons

  • Using misleading claims about licensing, legality, or guaranteed winnings

  • Brand bidding or use of SharkCasino trademarks in paid search (unless approved)

  • Spam, unsolicited messaging, or mass advertising

  • Cookie stuffing, forced clicks, or tracking manipulation

  • Incentivized traffic without written authorization

  • Self-referrals or referrals from related parties

Violations may result in immediate termination and loss of commissions.

7. Responsible Gambling

7.1 Affiliates must promote SharkCasino responsibly.
7.2 All promotional materials must:

  • Include responsible gambling messaging where required

  • Avoid portraying gambling as a financial solution

  • Avoid pressure-based or deceptive tactics

7.3 Affiliates must not promote SharkCasino to self-excluded players.

8. Tracking & Data Accuracy

8.1 All Player activity is tracked exclusively via RavenTrack.
8.2 SharkCasino is not liable for lost tracking caused by:

  • Ad blockers or cookie deletion

  • Browser or device restrictions

  • Improper link placement

  • External technical failures

8.3 Tracking data recorded by RavenTrack shall be considered final and binding.

9. Commission & Revenue Calculation

9.1 Commission models may include:

  • Revenue Share

  • CPA

  • Hybrid

9.2 Commission terms are defined individually within the Affiliate account.
9.3 Negative carryover.
9.4 Commissions are calculated based on Net Gaming Revenue.

10. Payments

  • Minimum payout threshold: $100

  • Payment frequency: Monthly

  • Payment methods: Bank Transfer, Crypto, etc.

10.1 Affiliates are responsible for providing accurate payment details.
10.2 We reserve the right to delay or withhold payments for fraud, compliance, or verification purposes.

11. Fraud & Abuse

11.1 SharkCasino reserves the right to void commissions generated through:

  • Bonus abuse

  • Duplicate or fake accounts

  • Stolen or fraudulent payment methods

  • Arbitrage, collusion, or manipulation

11.2 Proven fraud may result in permanent account termination.

12. Intellectual Property

12.1 Affiliates receive a limited, revocable, non-exclusive license to use SharkCasino branding solely for approved promotion.
12.2 All trademarks, domains, and creative assets remain the exclusive property of SharkCasino.
12.3 Unauthorized or misleading use of branding is prohibited.

13. Confidentiality

All non-public information, including commission terms, performance data, and business operations, is confidential and may not be disclosed.

14. Termination

14.1 Either party may terminate this Agreement at any time, with or without notice.
14.2 Upon termination:

  • All promotion must cease immediately

  • Outstanding commissions may be forfeited if violations occurred

15. Limitation of Liability

SharkCasino shall not be liable for indirect, incidental, or consequential damages, including loss of profits or data.

16. Amendments

SharkCasino reserves the right to amend these Terms & Conditions at any time. Continued participation constitutes acceptance of any updates.

17. Governing Law & Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of the Union of the Comoros (Anjouan).

18. Acceptance

By joining the SharkCasino Affiliate Program, the Affiliate confirms acceptance of these Terms & Conditions.

SharkCasino Affiliate Compliance Policy

This Affiliate Compliance Policy (“Policy”) forms part of the SharkCasino Affiliate Program operated via Obsidian Affiliates using RavenTrack. All Affiliates must comply with this Policy in addition to the Affiliate Terms & Conditions.

1. Legal & Regulatory Compliance

Affiliates must:

  • Comply with all applicable laws and regulations in the jurisdictions they target

  • Promote SharkCasino only where online gambling marketing is permitted

  • Clearly represent SharkCasino as an Anjouan (Union of the Comoros) licensed operator

  • Avoid implying licensing or regulation by MGA, UKGC, or any other authority

Affiliates are solely responsible for their compliance with local advertising laws.

2. Approved Marketing Practices

Affiliates may promote SharkCasino through approved channels, including websites, social media, streaming platforms, and paid advertising, provided that:

  • Content is accurate, fair, and not misleading

  • Bonuses and promotions are correctly described

  • Approved tracking links from RavenTrack are used

  • Marketing materials do not target restricted jurisdictions

3. Prohibited Conduct

Affiliates must not:

  • Target minors or vulnerable individuals

  • Promote gambling as a financial solution or guaranteed income

  • Use spam, unsolicited messaging, or deceptive advertising

  • Engage in brand bidding or trademark misuse without approval

  • Use incentivized traffic without written consent

  • Generate self-referrals or artificial traffic

  • Manipulate tracking, cookies, or attribution systems

4. Responsible Gambling

Affiliates must:

  • Promote gambling responsibly

  • Avoid pressure-based or aggressive messaging

  • Include responsible gambling messaging where required

  • Refrain from targeting self-excluded players

5. Restricted Jurisdictions

Affiliates must not target or accept traffic from restricted countries, including but not limited to:

  • United States

  • United Kingdom

  • France

  • Netherlands

  • Spain

  • Italy

The current restricted list is maintained within the Affiliate dashboard and may be updated at any time.

6. Monitoring & Enforcement

  • SharkCasino reserves the right to monitor Affiliate activity at any time

  • Violations may result in warnings, suspension, commission forfeiture, or account termination

  • Serious or repeated violations may result in permanent removal from the Program

7. Reporting Obligations

Affiliates must promptly notify SharkCasino of:

  • Regulatory inquiries related to their promotional activity

  • Any suspected fraud, abuse, or compliance breach

  • Changes to traffic sources or promotional methods

8. Policy Updates

This Policy may be amended at any time. Continued participation in the Affiliate Program constitutes acceptance of any updates.

Privacy Policy

Introduction

Palsar Capital Limited, henceforth referred to as “We” “Our” “Us” provides an affiliate programme to promote our clients on whose behalf We administer and manage the affiliate program. In this policy “affiliate” “you” and “your” refers to the individual entity that has agreed to promote the brands we provide marketing services for, in accordance with this Privacy Policy.

This Privacy Policy is designed to help you understand how we collect, use and safeguard your information.

This privacy policy should be read in conjunction with the Affiliate Programmes Terms and Conditions. By entering into any kind of contract with Palsar Capital Limited, you agree to the contents of this privacy policy. If you do not agree with any section of this privacy policy, you should not attempt to use our service.

Data Controller

The Data Controller is Palsar Capital Limited t/a Raven of Glassworks, 1 Back Turner Street, Manchester, M4 1FR

Personal Information

We collect and process the following data from (and about) you:

  • Your name, company name, address and contact details, including email address and telephone number;
  • Payment details including Electronic transfer address, and payment method owner.
  • A record of any correspondence between You and Us.

Personal information is collected for the following purposes

  • To administer the opening, management, and maintenance of accounts.
  • To enable Palsar Capital Limited to build an accurate profile of our client base and carry out statistical analysis.
  • To contact you for purposes including (but not limited to) sales reports, training, provision of promotional resources, newsletters, and other correspondence.
  • To monitor affiliate activity to ensure your compliance with the terms and conditions of the Active Wins Affiliates Affiliate Programme.
  • To monitor and process payments in relationship to your involvement in this Affiliate Programme.
  • All telephone calls to and from Palsar Capital Limited office(s) may be recorded for training and security purposes.

We implement effective processes to identify, manage, monitor and report risks and internal control mechanisms. These controls include secure systems and networks, and clear processes for privilege access rights. All data is stored securely.

Legal Basis for Processing

Our lawful basis for processing personal data include:

  • To fulfil a contract we have with you.
  • When it is our legal duty to do so.
  • When it is in our legitimate interest.
  • When you consent to it.

Who we share your personal information with

We may disclose your personal data to:

  • Palsar Capital Limited employees
  • contractors working with Palsar Capital Limited
  • regulators, and other legal authorities
  • the brands that you are promoting
  • auditors
  • payment providers
  • fraud prevention and compliance services
  • potential purchasers or investors
  • companies that you ask us to share your data with

All processing of information will be governed by the appropriate data protection laws.

Marketing

We will not send promotional or direct marketing, inclusive of email, SMS, or automated calls, without first obtaining your specific consent.

The consent requires a positive Opt-In either in electronic format, verbally or in writing. The consent will be clear and specific, granular, separate from other Terms and Conditions, name any third parties relying on the consent, and be easily withdrawable.

Data Transfers outside the EEA

We will not transfer Personal Data to recipients in Third Party countries that are outside of the EEA, or are not currently recognised by EU law as having an adequate level of legal protection for the rights and freedoms of data subjects unless:

  • The Processor is certified under the EU-U.S. Privacy Shield Framework.
  • The existence of any other specifically approved safeguard for data transfers (as recognised under EU Data Protection Laws) and/or a European Commission finding of adequacy can be demonstrated.

Data Retention

You may request that your Personal Data be anonymised in the following circumstances:

  • Where the Personal Data is no longer necessary in relation to the purpose for which it was originally collected/processed.
  • When you withdraw consent, if consent is being used as the Legal Basis for Processing.
  • If you object to the Processing and there is no overriding Legitimate Interest or Legal Obligation to continue the Processing.
  • The Personal Data was unlawfully processed.
  • The Personal Data has to be erased to comply with a legal obligation.

We will only retain data for the necessary time to complete the task that the data was collected for, or to meet our legal obligations.

Subject Access Request (SAR)

You are entitled to a file a Subject Access Request (SAR) to obtain a copy of the personal information which we hold about you. If you wish to receive a copy of this information, please contact your account manager, or the DPO directly, and allow up to thirty calendar days for the information to be collated and provided to you. Please note that your identity will need to be confirmed in order to complete a SAR, which may include the disclosure of other personally identifiable documentation in order to prove your identity (such as a passport scan, or valid proof of address) before commencing with the process.

Cookies

By using the Raven website, you consent to our use of ‘cookies’. A cookie is a small piece of information sent by a web server to a web browser, which enables the server to collect information from the browser. We use cookies and the information gained from them to analyse site usage, with this information used accordingly to improve our content and site layout and to remember your onsite preferences.

If you prefer, you can disable cookies in your web browser. The ‘help’ menu on the menu bar of most browsers will have a functionality to disable cookies.

Automated Decision Making and Profiling

Palsar Capital Limited do not use any automated systems in order to make decisions regarding your account which have any legal effect on You.

Right to Lodge a complaint

Please let us know if you are unhappy with how we have used your personal information in writing to the Data Protection Officer, who will be able to assist further with your complaint or concern. You also have the right to complain to the Information Commissioner’s Office.

Privacy Policy Status

This Privacy Policy is kept under continued review by Palsar Capital Limited and can be amended by Us at any time, and without notice to you. Whenever a change is made to the privacy policy which will affect your rights as a data subject, or change the intended processing purposes, then you will be notified directly and asked to agree to the new privacy policy. If you disagree with the changes made to the privacy policy, you retain the right to withdraw consent for future processing, as stated in the introduction to this policy.
